Some of this is still <br />stockpiled on site. Altogether, 9 structures were deleted of IS to be completed according to the <br />contract Claim Item #S a6ave addresses 3 of the 9 deletions Tlds claim is for the work to <br />quarry nprop for deleted xnrk (6 or more stnuctures), alor~ with compensation for the extra <br />rtp-ap CWL placed in the 6 structures built and the naulown area at the far north erui of the <br />channel <br />John Nelson asked CWG to use the extra rtprap in the structures CWL had built and place some <br />at'the North end of this dunutel where the cluatrtel ran out of the project area He indicated <br />at the time he would pay for this work At other times he balked when asked for compensation <br />CWG placed some of this ex7m rock in the structure built Also some was placed at the Nonh <br />end of the charuiel where it runs out of the project. <br />Please see the estimated quantities clause of the General Conditions. CWL demands to be paid <br />for the portion of the deleted work that CWL did prior to it being deleted also for the extra <br />work that John Nelson requested <br />Response: The PROJECT MANAGER never agreed to pay for the CONTRACTOR for <br />the rock which is not present on site. The rock was a by-product of reducing the East Pit <br />Highwall, and was not "quarried". <br />The PROJECT MANAGER never ageed to pay for extra rock placed in drop structures <br />or in the north end dam in the erosioif /ally. The CONTRACTOR had excess oversize rock <br />and the CONTRACTOR voluntarily placed some of the excess riprap in the drop structures. <br />John Nelson suggested putting some of it at the north end dam in an erosion gully. This <br />was done simply as a way to dispose of it, instead of having waste rock piles left on the <br />project site. The CONTRACTOR did not indicate that this would be a cost item and <br />therefore, no field order or purchase order was completed authorizing the work. The <br />CONTRACTOR was well aware of We need to obtain written authorization prior to <br />commencing extra work. <br />17 <br />
