<br />As specified in Task 12 and outlined on the Bid Schedule, the CONTRACTOR simply bid <br />on installation of erosion mat, erosion mat and riprap and concrete drop structures. A <br />review of the Bid Schedule shows that the CONTRACTOR bid as follows: <br />12a) WITH EROSION MAT 515.00 per In. ft.-51500.00 Total <br />12b) WITH EROSION MAT & RIPRAP-520.00 per ln. ft.-55,000.00 Total. <br />12c) WITHOUT EROSION MAT-5.30 per ln.ft.-5660.00 Total <br />12d) DROP STRUCTURES-51600 per each-524,000 Total <br />Change order 2 dated May 26, 1994 deleted all of 12a, all of 12b and part of 12d (3 <br />structures at 54800.00). Change Order 4 dated July 11, 1994 deleted part of 12d (6 <br />structures at 59600). Item 12c and the remaining portion of 12d, six drop structures were <br />paid for in full. All of 12c was paid in full render invoice 6 and six drop structures were paid <br />in full under invoices 5 and 6. <br />No portion of 12a and 12b was commenced nor were materials delivered. No construction <br />coaunenced nor were materials delivered for the deleted drop structures. No additional <br />payment is due. <br />Item # 6 Amount - $800.00 <br />The drawings included with the Special Conditions show a plan view of the concrete drop <br />structures CWG built It is unclear to this day which way they should face. The General <br />Conditions 1993, General Bid Specification #11, "Plans and Working Drawings ;states: '~7re <br />drawings if any, included with this specification are complete and adequate for construction. " <br />Response: The CONTRACTOR was informed several times about the orientation of the <br />drop structures. On May 3, 1994, Harry Rammey and John Nelson surveyed the locations. <br />Preston Mease was present at that time and discussed the orientation. <br />CWL's subcontractors excavated for the first structure on Saturday, lone Il. They formed and <br />poured concrete at 10:00 a.m. Monday lone 13th. They also excavated for 2 more stntctrtres <br />that day, and set the fonru for the second structure. John nelson was on site at 12:00 p.m., but <br />didn y inform anyone that he thought they were backwards until 3:00 p.m. The concrete crew <br />left and CWI, almost couldnY get them back <br />Response: John Nelson was on site and unloaded the grass seed at 12:30 PM. He then <br />talked to Al, foreman of the concrete contractor, about the wrong orientation of the <br />structures. This was done eazlier than 3:00. Al then went to town to call Tom Matot, the <br />concrete subcontractor. The other two workers stopped work to wait for orders from Al or <br />Tom) <br />12 <br />
