The weight of the evidence demonstrates that the Applicant has complied <br />with the minimum requirements of Construction Materials Rules <br />6.4.5(2)(f)(ii) and (iii). <br />N. Secondary Containment of Hazardous Materials <br />Construction Materials Rule 3.1.5(11) prevents the unauthorized release of <br />pollutants into the groundwater from any material mined, handled or <br />disposed ofwithin the permit area. <br />2. The Objectors assert that the Applicant failed to comply with Construction <br />Materials Rule 3.1.5(11) <br />3. The Applicant has received approval of a secondary containment plan that <br />includes heavy duty lined earthen berm storage areas that will be <br />constructed prior to any storage of hazardous materials on the site. The <br />Applicant has stated that he will abide by all applicable state regulations <br />concerning the use, storage and disposal of all such materials. The <br />Applicant must notify the Division, and all other applicable authorities, if <br />a reportable quantity release occurs, as set forth in the stipulation hereto. <br />4.
