The original access road to the Weat Pit <br />hae been reclaimed by the contractor performing work at the G.E.C. East Pit under <br />the direction of AML. The purpose of this letter is to define the work to be <br />conducted in the West Pit as well as access through the Southfield Mine across <br />Magpie Creek Diversion. <br />Phil Kessler has estimated a cost to cross and repair Magpie Creek Diversion, and <br />this cost will be included in the scope of work. The Division proposes to access <br />the West Pit through the Southfield Mine and across Magpie Creek Diversion off <br />of light use road Y8. The Diversion will be modified to allow for passage of <br />equipment to the West Pit. During the period of interruption in Magpie Creek, <br />the Division will assume responsibility for the condition and maintenance of the <br />drainage area affected as these factors pertain to the Colorado Coal Regulations. <br />The Division will restore the affected area of Magpie Creek Diversion to the pre- <br />construction condition, as specified in the Southfield Permit. Upon completion <br />of the West Pit Diversion, the Division will meet with Energy Fuels in the field <br />for the purpose of agreeing that the affected area of Magpie Creek Diversion <br />meets the specifications set forth in the permit. Thereafter, the Division will <br />return responsibility of the affected area of Magpie Creek Diversion to Energy <br />Fuels. <br />The Contractor is required to provide liability insurance and workmans <br />compensation insurance as condition of being awarded the reclamation contract per <br />Division of Contracting requirements.
