I will address the complainants <br />letter in the order presented. I believe-each item in this <br />letter has been addressed in the past and are mainly due to the <br />Grand County Assessors maps and files being incorrect at the time <br />the adjoining owner research was completed. Since the County <br />Assessors records are those of "record", as required by rule <br />6.4.15 and defined in 1.1(34), then we would have had no way of <br />knowing if they were incorrect or not. We can only assume they <br />were correct until proven wrong. Attached is a letter from G&H <br />Engineering explaining what they found when Ms. Paula Sheridan <br />raised this issue in June 2004 after the public comment period <br />ended and after the application was approved by the Division of <br />Minerals and Geology. <br />Background: <br />Ms. Sheridan called at 2:19 p.m. on June 8, 2004 asking why <br />she was not notified that the permit was filed with the state. I <br />told her I would have to get some information and that I would <br />get back to her. I also suggested she call G&H Engineering to <br />try to clarify what was wrong. I then began to investigate her <br />complaint that resulted in the G&H letter and correction of the <br />Pre-Mining Plan Map. We would have submitted this revised map at <br />the first Annual Report. <br />I called Mr. Carl Mount on June 9, 2004 to explain the <br />problem Ms. Sheridan had raised and asked for some direction from <br />the Division as to what we should do. Mr. Mount asked if we had <br />done the proper public notice and the 20 day comment period and I <br />stated that we had. I explained that the first publication was <br />on March 18, 2004 and the public comment period ended on April <br />
