XH. Post-mining Land Use <br /> 1. The Division is proposing to approve a post-mining land use of rangeland and <br /> wildlife habitat. The land use meets the criteria of Rule 4.16.3. <br /> XIII. Protection of Fish, Wildlife and Related Environmental Values <br /> 1. Information regarding compliance with Rule 4.18 is located in Section 2.05.4 of <br /> the permit document. <br /> 2. Wildlife habitat is a planned post-mining land use. The applicant has selected <br /> appropriate plant species and distributions to benefit wildlife. <br /> XIV. Protection of Underground Mining <br /> 1. There are no current or proposed surface mining operations within or next to the <br /> West Elk Mine. <br /> XV. Subsidence Control <br /> 1. The applicant has proposed a subsidence control plan in accordance with Rule <br /> 2.05.6(6) and has committed to adopt all measures in order to reduce the <br /> likelihood of subsidence, prevent material damage, or mitigate the effects. The <br /> Division proposes to approve the plan (4.20.1(2) and 4.20.3(1)). <br /> A subsidence monitoring plan to monitor mining in the Apache Rocks and Box <br /> Canyon lease areas for the five-year permit area is included in Section 2.05.6(6) <br /> of the permit document. The monitoring plan will provide additional data which, <br /> when used with the F Seam data, can be utilized for future mine planning <br /> considerations. MCC has proposed two additional north-south monument lines <br /> and two additional east-west monument lines to monitor B Seam only mining <br /> subsidence, which will evaluate mining in the Jumbo Mountain Tract. <br /> The effect of mining-induced subsidence on renewable resources, structures, and <br /> geologically unstable areas in the five-year permit term is discussed in a report <br /> entitled, "Subsidence Evaluation for the West Elk Mine" and can be found in <br /> Exhibit 55, revised and updated in November 1997 and November 1999. <br /> 2. The applicant has proposed a subsidence monitoring program, in accordance with <br /> Rule 2.05.6(6)(c), designed to determine the commencement and magnitude of <br /> subsidence movements. Maps included in Exhibit 60 depict the location of <br /> monuments to be installed and structures to be monitored within the permit and <br /> adjacent area. The results of the monitoring program will be submitted to the <br /> Division semiannually. The monitoring program is designed to extend for a time, <br /> beyond cessation of mining in any area, consistent with the need for verification <br /> of the subsidence prediction. <br /> 55 <br />
