-12- <br />A copy of the cultural resources report was reviewed by the Colorado State <br />Historic Preservation Officer. That office confirmed that there area no known <br />resources within the affected area (see Exhibit A). <br />Pursuant to Rule 2.07.6(2)(e), the Division finds that the proposed operation <br />will not adversely affect any publicly owned park or place listed on the <br />National Register of Historic Places. <br />The application is in compliance with this section. <br />IV. Climatological Information and Air Resources - Rules 2.04. <br />Climatological information for the permit area is <br />the permit application. An air pollution control <br />2.05.6. The air emission permit is in Exhibit 9 <br />This section is in compliance. <br />V. Geology - Rules 2.04.5 and 2.04.6 <br />found in Section 2.04.8 of <br />plan is presented in Section <br />of the permit application. <br />A detailed description of the geology of the proposed permit area and adjacent <br />area is contained under Section 2.04.6, of the permit application. Additional <br />information on the geology of the permit and adjacent area is shown on Map 2, <br />Mine No. 3 Geology; Map 3, Geologic Cross-Sections; Map 21 a, Detention Basin <br />Cross-Sections; Exhibit 1; Tables 1, 2, 3, and 4; and Figures 1 and 2. <br />Results of chemical analyses of overburden samples from the Energy No. 3 Mine <br />are presented in Table 4, Overburden Chemical Data. The applicant has <br />included overburden geochemical analyses from five drill holes within the <br />proposed permit area; geographic and vertical sampling density are in <br />accordance with State guidelines for overburden geochemistry. No <br />acid-forming, toxic-forming or alkalinity producing materials have been <br />identified. <br />No data are available in the permit application on chemical analysis of the <br />Lennox Coal Seam. This coal seam, which is known to be somewhat high in <br />pyritic and organic sulfur content in the Twentymile Park Basin, occurs in the <br />western portion of the area to be surface mined, and will be spoiled with the <br />overburden. Given the small quantities of the Lennox coal seam to be spoiled <br />(a rough estimate is 5Y or less of the total overburden in the area to be <br />mined), and the fact that the Lennox has been spoiled at this mine and other <br />operations in the immediate area in the past with apparently little related <br />problems, the lack of site-specific data for the Lennox is not considered a <br />significant environmental concern. <br />The permit application is in compliance with Rules 2.04.5 and 2.04.6. <br />
