~~ <br />47HEREAS, the Board of County Commissioners has held a <br />public hearing on the matter, notice of said heariny was duly advertised <br />according to law. <br />IOW, TIiEREFORE, BE IT RESOLVED that the above mentioned <br />Special Use Permit be issued to Rockcastle Company for the purpose of <br />extracting coal on the following lands: <br />A 740 acre parcel located in Sections 20, 21, 28, <br />29, 31 and 32, Township S North, Range 37 I4est <br />of the 6th P.'+1., lying south and west of County <br />Road 27 along Grassy Creek. <br />BE IT FURTIiER RESOLVED, that the Special Use Permit shall <br />be subject to the following conditions: <br />1. THAT, the life of the permit be for a period of ten <br />(10) years, and <br />2. THAT, the Company shall provide domestic coal for use <br />by the residents of Routt County commencing within <br />six (6) months of the operation and continuing throughout <br />the period of this permit, and <br />3. THAT, the County be made co-beneficiary on any bond <br />required by the State, and <br />4. THAT, reclamation should return the mined land to <br />range land and wildlife habitat to include wheat grass, <br />brome, blue grass, wild rye, aspen service berry and <br />Gambls oak, and <br />5. THAT ponds shall be constructed in the five (5) mined <br />areas, and <br />6. THAT the County shall be notified if any non-point dis- <br />charge permit is to be requested, and <br />7. THAT no stockpile shall be located within the elevation of <br />the 100 year flood plain, and <br />8. THAT the Company shall work with h'es Signs' office and do <br />whatever is necessary for maintaining the water flow <br />through Grassy Creek, and <br />9. THAT the road maintenance agreement attached hereto and <br />marked as Exhibit A providing for the maintenance of <br />County Road 27 shall be part of this Special Use Permit. <br />-2- <br />:v. <br />
