26 <br />a. Certified Hail, Return Receipt Requested. The authorized officer <br />Trill send all decisions on lease suspensions to the lessee by <br />certified mail, return receipt requested. Vhere there is a <br />sublessee or operator, a copy of the authorized officer's decision <br />also viii be sent to that party by certified mail, return receipt <br />requested to ensure receipt. <br />b. Suspension Approved. If it is determined that a auapenaioa sill <br />be granted, the authorized officer will decide the appropriate <br />duration of the suspension period and Trill issue a decision <br />approving the suspension. The decision approving the suspension <br />of a coal or solid mineral lease or INU will clearly state the <br />conditions for the auapension, including the following: <br />° The effective date of the suspension, the length of the <br />approved suspension period, and the expiration date of the <br />auapension; <br />'hie applicable suspended lease terms and other requirements <br />and the date upon which suspension of those terms begins; <br />° Toe lease terms and conditions that ere not suspended; <br />° Any special suspension atipulationa recommended by other <br />Federal Agencies; and <br />° The conditions under which the lease suspension will terminate. <br />Suapeneiona that are approved under these guidelines will be <br />subject to the following additional conditions ae stated in the <br />authorized officer's decision: <br />° The authorized officer shall be notified immediately upon the <br />cessation of the condition, situation or event which <br />constituted the basis for the auapenaioa; <br />° Por a auapension of operations and production or a auapension <br />of operations, the authorized officer shall be notified by the <br />lessee immediately upon recommencement of beneficial use of <br />the lease. ibis requirement does not apply to a force majeure <br />auapension; <br />If the approved suspension period exceeds 1 year, the lessee <br />must certify, prior to the end of each successive 12-month <br />period following the effective date of the suspension, that <br />the conditions justifying the suspension continue; and <br />° Failure of the lea see to notify the authorized officer of a <br />change in status of the suspended lesse(e) or to certify a <br />continuing need for the auapension will result in the <br />immediate termination of the suspension by the authorized <br />officer. <br />*a Update all AL,~IILS and SI24S data elements related to or <br />affected by the suspension. <br /> <br />Attachment 1-29 <br />
