Begej <br />Mined Land Reclamation Div. <br />1313 Sherman St. <br />Denver, CO 80203 <br />Dear Ms. Begej: <br /> <br />RECEi'~E;~ <br />SEP 0 81992 <br />DIVISiUi` sir <br />MINERALS & GCO~..OG~ <br />The Corley Company, 635 Southpointe Ct., Colorado Springs, CO 80906, is <br />hereby petitioning the Colorado Mined Land Board for a declaratory <br />order. <br />The Corley Company is the land owner of the NE ~ Sec. 30, T20S, R69W; <br />and is permittee C-81-045, covering an area not related to this <br />petition. <br />The petition relates to Rules 4.07.1 and 4.07.3. <br />On May 19, 1992, Mined Land Reclamation Division in a letter from you, <br />Ms. Begej, notified us that Sheridan Enterprises performed a drilling <br />program at the Newlin Creek Mine in 1978. You identified the drill hole <br />near the West Pit to be Sheridan Enterprises' drill hole NC-7. <br />According to your inspection report of the GEC mine on May 5, 1992, the <br />access road to the drill hole is 10 feet by 150 feet and that ingrowth <br />of natural vegetation was the only reclamation of the area. <br />Because fourteen years is an excessive period to delay reclamation, and <br />because four months has followed identification of the above stated <br />rules violation, we are requesting that the Board issue a declaratory <br />order for immediate reclamation of the drill hole area. <br />Sincerely, <br />%1~ ` , ~~ <br />W.D.
