revision to the PAP. This technical revision should be submitted for approval well in advance of <br />the bond release application. <br />6. It is the responsibility of the operator to develop and obtain approval from the Division <br />for a noxious weed management plan. An approved plan must be implemented whenever <br />infestations of noxious weeds occur on the permit area. Weed patches including Houndstongue, <br />Canada Thistle, and Hoary cress have been identified in many locations of the Seneca II Mine <br />permit area. The Division is aware that Routt County has required SCC to develop a detailed <br />weed management plan as well. Please update or incorporate this management plan into the <br />existing plan required by the DMG. Please also ensure that noxious weeds are controlled in all <br />aeeas of the permit, according to the approved weed management plan. Based on review of the <br />2003 Annual Reclamation report, it appears that only the facilities area and locations along the <br />county road up to the Pecoco impoundment were sprayed in 2003. Please submit a noxious weed <br />management plan. <br />SECTION V -PERMIT VARIANCES AND SPECIFIC APPROVALS <br />The Division previously granted variances from contemporaneous reclamation requirements for <br />the active Wolf Creek and Wadge mining areas, Auger Area E, and the solid waste disposal area. <br />Mining has been completed in the Wolf Creek and Wadge mining areas, and the variances aze no <br />longer necessary. A variance from contemporaneous reclamation for Auger Area E is no longer <br />necessary. The azea, last mined in 1985, had been left open to facilitate future underground mine <br />portal faceups. <br />The solid waste disposal area has not been regraded. The disposal area, a previously mined <br />Wadge azea pit, is currently in use. The vaziance granted for the solid waste disposal area <br />remains appropriate. <br />SECTION VI -BONDING SUMMARY <br />The Division currently holds a total of $11,673,859.00 in corporate sureties for the reclamation <br />performance bond at the Seneca II Mine. Of that total, $10,182,123.00 applies to Permit Number <br />C-80-005. The remainder applies to areas mined prior to the issuance of Permit Number C-80- <br />005. The bond liability cost estimate was last updated with Permit Renewal No. 4 and was <br />established at $8,034,357. Reclamation unit costs including equipment, fuel, labor etc. were <br />updated for 2001/2002 at the time of the last permit renewal increase. Since the effective date of <br />Permit Renewal No. 4 (February 17, 2002) there have been no revisions to the permit to require <br />an increase in liability. <br />As a result of this midterm review, the performance bond liability for the current permit area has <br />been established at $7,815,301. Again the reclamation unit costs were updated and there has <br />been no credit given for any reclaimed lands because SCC has not filed for a bond release. The <br />Division finds that the performance bond held is adequate to cover reclamation of the site in <br />accordance with the approved reclamation plan. <br />5 <br />
