Box 103 <br />Delta, Colorado 81416 <br />RE: Unauthorized Discharge Point <br />Delta Sand and Gravel <br />CDPS N0: CO-0034321 <br />Delta <br />Dear Mr. Starner: <br />F/ ~L //~ <br />NJ~ 77'~v <br />Approximately one year ago, the state district engineer inspected your operation <br />and noted that a discharge pipe associated with the gravel washing operation was <br />present whereby wastewater from washing would be released to a ditch to the <br />Gunnison River. By letter, dated February 16, 1984, the district engineer advised <br />you that this discharge was not covered by your permit. To comply with the law, <br />the options available were to either amend the permit to add the new discharge <br />point, or to reroute the wastewater to the pit and thus not discharge through the <br />unauthorized point. <br />The district engineer recently reinspected your facility and found conditions with <br />respect to the permit unchanged. <br />You are to respond in writing by no later than January 31, 1985 describing how you <br />plan to comply with the law and your permit. If you elect not to amend the permit <br />to add this point of discharge, then describe in detail how the gravel wastewater <br />will be handled to preclude the use of this unauthorized point.
