Colorado 81101 <br />rtrt~ 20P <br />W <br />n~ ~b vG~ <br />Re: Solid Waste Disposal Site at Deer Valley Peat Mine, Highway 160, 8 miles East of Alamosa, <br />Alamosa County, CO ~2rw+t f" /~o, ;/b1-/y~/5~-og J <br />Dear Mr. Barrier: S I ~e ~ l ecr.-r l~ ~ h 2 <br />This letter provides notice related to information gained during a field inspection conducted by our <br />staff at the Colorado Department of Public Health and Environment (the Department) of an <br />unpermitted solid waste disposal site at the Deer Valley Peat Mine located on Highway 160, 8 miles <br />east of Alamosa. The area is considered an active mine and the Department of Natural Resources <br />permit number is M1994081. The inspection was performed in response to a complaint. Ms. Julie <br />Cotter was assigned to conduct the inspection on behalf of the Solid Waste Unit of the Compliance <br />Program of the Department's Hazardous Materials and Waste Management Division (Division). The <br />Department advises you that the information obtained by the Department indicate that you may have <br />violated Colorado's solid waste laws. Department staff will conduct further review of the facts <br />established by the field inspection and this notice may be revised to include additions or <br />clarifications that result from that review, <br />Please be aware that you are responsible for complying with the State solid waste regulations and <br />that there are civil penalties for failing to do so. Section 30-20-113, C.R.S. provides that any person <br />who violates the Act and the Colorado Regulations Pertaining to Solid Waste Disposal Sites and <br />Facilities, 6 CCR 1007-2 (the regulations) may be subjected to a penalty of not more than $2,000 <br />per violation per day during the period that such violation occurs. Based on the findings of my <br />inspection, the site may be in violation of the Colorado Regulations Pertaining to Solid Waste <br />Disposal Sites and Facilities (6 CCR 1007-2). The site deficiencies are listed below. <br />Operating Deficiencies <br />1) The solid waste disposal area, which covers several acres, does not have a certificate of <br />designation in apparent violation of Section 1.3.3. The site meets the definition of a solid waste <br />disposal facility and corrective action must be performed. <br />•2) The solid waste disposal site does not meet minimum standards in apparent violation of <br />Sections 2 and 3. ~ , - <br />To avoid additidnal enforcement action or reduce the penalty described above you must either <br />correct the above listed condition or demonstrate to the Department that the condition observed is <br />not a violation of the Act and Regulations, within 30 days of receipt of this letter, as documented by <br />return of the certified mail receipt. <br />
