The tunnels were driven <br />partially to the coal seam but never contacted the coal. All structures <br />except the water tank at the west portal site have been removed. The entire <br />area excluding the road surfaces have been hydromulched and seed is generally <br />progressing well. However, there is a great degree of activity from wildlife <br />in the area that tends to take advantage of this source of feed. <br />The mine was issued a permit for three years only due to the fact that some <br />major issues could not be resolved during the original permitting. The major <br />issue left unresolved was permitting of a refuse area. The permit was due to <br />expire on 5/30/88. Extensions have been granted since this time. During the <br />midterm review an extensive adequacy letter was sent to the operator. <br />However, the Division granted that these issues could be postponed until <br />renewal due to the financial situation of the mine. The operator submitted <br />minimal items required to call the permit renewal operation completed. The <br />completeness was issued on April 12, 1988. The completeness by this deadline <br />insured the operator of the right of successive renewal of the existing <br />permit. At this time, Mr. Matthies of the Newcastle Energy Company was again <br />informed that the adequacy issues addressed by Jeff Deckler during the midterm <br />review would need to be addressed prior to permit issuance. Also, at this <br />time the operator was informed that Newcastle must submit the permit renewal <br />application as one stand-alone documem incorporating all revisions to date. <br />From that time to date, the operator submitted very minimal information <br />addressng the old midterm issues. The new application did address a method of <br />stowing the refuse back in the mine, requiring little on the ground surface <br />storage. A meeting was subsequently held with me, Jim Pendleton, Jeff Pecka, <br />and Peter Mattiss of Newcastle Energy Corporation. At this time general <br />inadequacies of the refuse stowage plan were addressed as along with the <br />emphasis of previously existing adequacy issues from the midterm. From play <br />31, 1988 on, no substantial progress was made by the operator to address any <br />of the adegaucy issues. The lack of financial backing was given as the reason <br />for this lack of response and the Division was requested to grant several <br />extensions of the permit renewal revision.
