Central Expressway, Suite 175 <br />Dallas, Texas 75231 <br />RE: Fruita ill and 2 Mines, Mesa County, Colorado, File C-81-015 <br />Dear Mr. Crichton: <br />Tne Division has become increasingly concerned with the lack of progress <br />toward permitting this coal mine by American Shield Coal Company. <br />At this time last year, representatives of American Shield Coal Company (ASCC) <br />withdrew three permit applications for this area, and were actively discussing <br />pursuit of a reclamation only plan for the existing Fruita ~1 and 2 <br />aisturoance and the permitting of a small surface mine. These plans did not <br />proceed oeyond the discussion stage, and in January 1984 the Division was <br />notified that ASCC was no longer interested in pursuing these options and was <br />in the process of reassigning the leases at Fruita. Since that time, tnere <br />has been no contact witn ASCC and no activity toward securing a permit for <br />these areas wnich have remained unpermitted since 1981. <br />At this point the Division must take steps to conclude our reclamation <br />obligations unaer the Colorado Surface Coal Mining and Reclamation Act of <br />1979. This obligation entails forfeiture of the reclamation bond and <br />reclamation of the disturoed area. <br />Unless ASCC suomits a complete reclamation permit application by August 15, <br />1989, Tne Division will request the Colorado Mined Land Reclamation Board to <br />forfeit the pond at the August 23-24, 1989 meeting and initiate on-tne-ground <br />reclamation. <br />If you have any questions please contact me or Micnael Savage at your earliest <br />convenience. <br />Sincerely, <br />Micnael B.
