undermining of approximately four (4) miles of Routt County Road No. 33. These four miles of <br />road lie within the area affected by longwall panels 9R, 8R, 7R (PR-03), 6R and SR (PR04). <br />There was no public response or concern voiced about undermining of the road. The applicant <br />received all necessary approvals from Routt County to undermine County Road No. 33. Special <br />Use Permit No. 92-233 issued by Routt County approved the undermining and subsidence of <br />County Road No. 33 as long as the conditions addressing appropriate road warning signage, <br />monitoring, and repairs are met by Twentymile Coal Company. Based on the above information, <br />the Division finds Twentymile Coal Company in compliance with Rule (2.07.6(2)(d)(iv)) for the <br />undermining of Routt County Road No. 33. <br />Approval of PR-04, April 20, 1998, allowed for continued mining in the Eastern Mining District <br />of Longwall panels 6R through 2R. Only panels 6R and SR had an impact to Routt County Road <br />No. 33. Experience gained during subsidence of panels 9R through 7R demonstrated that traffic <br />on County Road No. 33 was not interrupted as a result of the subsidence of the road. Subsidence <br />of Longwall panels 6R and SR did not interrupt traffic on Routt County Road No. 33. <br />Approval of PR-OS allowed longwall panel 12 Right to undermine a Twentymile sandstone <br />outcrop in Section 14, TSN, R86W. Prior to approval TCC demonstrated there was a very slight <br />potential for rock from this outcrop to reach Routt County Road 33 as a result of the <br />undermining. TCC committed to scaling loose rock on the slope prior to undermining, using <br />concrete barriers along the north side of Routt County Road 33 (as necessary), and draping chain <br />link mesh over the outcrop. <br />Mining proposed in PR-06 is more than one-quarter mile from public roads <br />h) Three hundred feet of an occupied dwelling unless a written waiver from the owner has been <br />provided. TCC successfully complied with Stipulation No. 36 for the Southwest Mining District <br />on March 25, 1994 for the mobile home owned by Mr. Robert Perry. Three dwellings were <br />undermined in the Eastern Mining District (Longwall Panels 6R-2R) during 1999. One had been <br />occupied year round, one was vacant and is owned by Twentymile Coal Company, and the third <br />was occupied only during portions of the yeaz. Twentymile Coal Company has a subsidence <br />agreement with Mr. Kenneth Ashley regarding his dwellings. (2.07.6(2)(d)(v)). <br />The full-time residents were moved by Twentymile Coal Company to alternative accommodations <br />prior to subsidence of the house. Twentymile Coal Company took precautions with the home by <br />bracing floor joists and door frames prior to undermining. The house was located near the center <br />of Longwall panel 5 Right. After subsidence occurred, Twentymile Coal Company and the <br />Ashley's agreed upon mitigation of the house by replacement of the structure. Twentymile Coal <br />Company demolished the original structure, backfilled the foundation, constructed a new <br />foundation and installed a modular home as agreed upon with the landowner. The smaller <br />residence owned by the Ashley's overlay gateroad 6 Right, and experienced roughly 4 inches of <br />subsidence. Twentymile Coal Company conducted repairs to the smaller residence in accordance <br />with the subsidence agreement with the Ashley's in the fall of 1999. The residence owned by <br />Twentymile Coal Company also overlay gateroad 6 Right. This structure was not monitored for <br />subsidence impacts and will not undergo any mitigative measures as a result of subsidence. <br />5. On the basis of information obtained from the State Historic Preservation Office (SHPO) and <br />archeological and cultural resource surveys submitted by the applicant, the Division finds that <br />subject to valid existing rights as of August 3, 1977, the mining operation will not adversely <br />affect any publicly owned pazk or place listed on or eligible for listing in the National Register <br />15 <br />
