TCC satisfied the requirement of Stipulation No. 59 on June 27, 2000, and the Stipulation is no longer <br />active. <br />Stipulation No. 59 <br />PARTIAL APPROVAL FOR PERMIT REVISION NO. 3 (PR-03), FOR THE FOIDEL CREEK MINE IS <br />CONDITIONAL UPON RESOLUTION OF THE PITTSTON COMPREHENSIVE SETTLEMENT <br />AGREEMENT THAT COVERS THE VIOLATIONS OF A & D COAL, BLACK GOLD COAL, ELKOQS <br />ENERGY, ELKINS COAL, GOLDEN CHIP COAL, BROTHERS COAL, D & J COAL, JANICE MARIE <br />COAL, AND GLORY COAL. PROOF OF RESOLUTION OF THIS COMPREHENSIVE AGREEMENT <br />MUST BE SUBMITTED TO THE DMSION AS SOON AS IT BECOMES AVAILABLE. <br />Stipulation No 60 was complied with on August 31, 1999. <br />Sfipulation No. 60: <br />REPLACE FIGURE 16J WITH A REVISED MAP 23. <br />Section A -Rule 2.07.6 <br />1. The permit application is accurate and complete. All requirements of the Act and these rules have <br />been complied with (2.07.6(2)(a)). <br />2. Based on information contained in the permit application and other information available to the <br />Division, the Division fmds that surface coal mining and reclamation can be feasibly accomplished at <br />the Foidel Creek Mine (2.07.6(2)(b)). <br />3. The assessment of the probable cumulative impacts of all anticipated coal mining in the general azea <br />on the hydrologic balance, as described in 2.05.6(3), has been made by the Division. This assessment <br />entitled "Yampa River CHIA" (revised November 2003) is available for inspection at the offices of the <br />Division. <br />A brief summary of the Probable Hydrologic Consequences of the Foidel Creek Mine follows. <br />Ground water <br />Several possible effects to the ground water system have been identified. <br />Dewaterine and ootentiometric drawdown in bedrock units <br />Dewatering will occur in the Wadge overburden, possibly out as faz as the outcrop azound the margins <br />of the basin. Dewatering will occur in the Twentymile sandstone above the azea of active mining. <br />Drawdown will occur in the Trout Creek sandstone if communication with the mine is established <br />through fault zones. Monitoring data indicates no impact to the Trout Creek sandstone to date. <br />10 <br />
