Furthermore, this Department has no record Kirkland Construction is conducting its mining and extraction activity on the subject property in accordance with a valid permit from the State of Colorado, Division of Minerals and Geology. P, 3 Condition No. 8 requires the applicant to develop, operate, and manage the mining-related activity according to the rules, regulations, plans, and permits administered by the applicable Federal, State, and local agencies. In addition, any violation of a Wile, regulation, permit, or plan may result in the scheduling of a Show/Cause Hearing to consider the revocation of Special Use Permit No. 98-06. The applicant, Kirkland Construction, has violated the conditions imposed upon the Special Use Permit by the local Planning Commission. You must correct these violations of the conditions of approval for Special Use Permit No. 98-06 within thirty (30) days after the date of this letter set forth above. Failure to correct these violations within the stated time frame may result in a Show/Cause Hearing by the Planning Commission to consider revocation of Special Use Permit No. 98-06. Failure to connect these violations may also result in legal action being instituted against you by the County of Pueblo. Under new legislation recently enacted by the Colorado Legislature, if the Court determines that you have violated the Pueblo Countv Zonins Resolution, it must impose a Fine of at least $250, and has the discretion to impose a greater fine not to exceed $500. Once a court determination has been made that the property and/or activity is in violation, for each and every day thereafter that the violation(s) islare not corrected, the Court may impose an additional fine of up to $50 for each day the violation(s) continues.
