Violations <br />7/14/88 <br />Page 2 <br />F..-.X 110, 7i': 633 6376 <br />As of this date, this Department has not received copies of any Federal, State, or local <br />permit applications, approvals, amendments, or releases from the applicants. <br />Furthermore, this Department has no record Kirkland Construction is conducting its <br />mining and extraction activity on the subject property in accordance with a valid permit <br />from the State of Colorado, Division of Minerals and Geology. <br />P, 3 <br />Condition No. 8 requires the applicant to develop, operate, and manage the mining-related <br />activity according to the rules, regulations, plans, and permits administered by the applicable <br />Federal, State, and local agencies. In addition, any violation of a Wile, regulation, permit, or plan <br />may result in the scheduling of a Show/Cause Hearing to consider the revocation of Special Use <br />Permit No. 98-06. The applicant, Kirkland Construction, has violated the conditions <br />imposed upon the Special Use Permit by the local Planning Commission. <br />You must correct these violations of the conditions of approval for Special Use Permit No. <br />98-06 within thirty (30) days after the date of this letter set forth above. Failure to correct <br />these violations within the stated time frame may result in a Show/Cause Hearing by the <br />Planning Commission to consider revocation of Special Use Permit No. 98-06. <br />Failure to connect these violations may also result in legal action being instituted against you by <br />the County of Pueblo. Under new legislation recently enacted by the Colorado Legislature, if the <br />Court determines that you have violated the Pueblo Countv Zonins Resolution, it must impose a <br />Fine of at least $250, and has the discretion to impose a greater fine not to exceed $500.
