averaging about 2000 mg/1. The 2000 mg/1 average is the concentration level <br />at which the spoils spring discharges are thought to be most representative of <br />conditions at the Seneca II Mine site. <br />In about 1977, the Water Resources Division of the United States Geological <br />Survey (USGS) began a lysimeter study at the Seneca II Mine to determine spoil <br />aquifer discharge quality, and how that quality changes over time. As mining <br />becomes more concentrated in Twentymile Park, the long-term quality impacts to <br />the hydrologic balance will become increasingly more important. A stipulation <br />in the original permit requires Peabody Coal Company to submit the report to <br />the Division upon its completion. This stipulation, which follows, will be <br />carried over into the second permit term as it has not yet been resolved. <br />STIPULATION N0. 2 <br />WITHIN 90 DAYS OF ITS PUBLICATION, A COPY OF THE UNITED STATES GEOLOGICAL <br />SURVEY'S LYSIMETER STUDY MUST BE SENT TO THE DIVISION AND OSM TO PROVIDE <br />ADDITIONAL QUANTITATIVE DATA ON FLOW RATES AND WATER QUALITY OF THE SPOIL <br />LEACHATE. <br />With the continued acceptance of the above stipulation, the operation is in <br />compliance with the requirements of this section. <br />VII. Alluvial Valley Floors - Rules 2.06.8, 2.07.6(2)(k) and 4.24 <br />Alluvial Valley Floor Identification <br />Information pertinent to alluvial valley floor (AVF) determinations is <br />provided in Volume I, Tab 7, Section YII.B. of the permit renewal application <br />dnd Volume III, Appendix 7-7 of the original permit application. Additional <br />information used by the Division in the identification of potential AVF <br />locations was Map 15 (Alluvial Valley Floors, Land Use and Water Rights} from <br />the Foidel Creek life-of-mine permit application (C-82-056). <br />Potentially affected portions of Fish Creek <br />Creek below Fish Creek have previously been <br />criteria in the review of two coal permits <br />and Fish Creek Tipple (C-81-036). Selected <br />and lower Trout Creek were determined to be <br />in the respective permit findings documents <br />and the lower reaches of Trout <br />evaluated with respect to AVF <br />the Foidel Creek Mine (C-82-056) <br />alluvial deposits along Fish Creek <br />AVFs by the Division as referenced <br />The previous AVF finding made by the Division at the time of initial permit <br />approval for Seneca II Mine included an exemption for operations conducted <br />prior to August 3, 1977 within or adjacent to an AVF. The lands to which this <br />grandfather clause apply are located within the Grassy Creek drainage. A 45 <br />acre area near the confluence of Little Grassy Creek and Grassy Creek and a 40 <br />acre area along Little Grassy Creek which have been identified as AVFs remain <br />exempt and, as such, were not reevaluated. <br />Non-exempted areas in the Fish Creek drainage basin were reexamined, in <br />conjunction with a regional AVF study conducted by the Division, to identify <br />if any significant impacts would occur from the proposed operations at <br />Seneca II Mine. <br />-15- <br />
