the permittee submit a statement insuring that all undisturbed, non-surveyed <br />areas in the permit area would remain undisturbed, and that if previously <br />unplanned surface activities became necessary in those areas, the permittee <br />would submit a cultural resources survey and description of the proposed <br />disturbance. An adequate archaelogical statement was subsequently <br />incorporated into Appendix 5-2 of the application, thereby satisfying the <br />requirements of the stipulation. <br />An additional stipulation was attached to the initial 5-year permit approval <br />regarding necessary actions to be taken if previously unidentified cultural <br />resources were discovered during the course of mining. This stipulation is <br />ongoing in nature and must remain in effect throughout the second permit term. <br />STIPULATION N0. 1 <br />IF DURING THE COURSE OF MINING OPERATIONS, PREVIOUSLY UNIDENTIFIED CULTURAL <br />RESOURCES ARE DISCOVERED, THE PERMITTEE SHALL INSURE THAT THE SITE IS NOT <br />DISTURBED AND SHALL NOTIFY THE COLORADO MINED LAND RECLAMATION DIVISION AND <br />THE UNITED STATES OFFICE OF SURFACE MINING (OSM). THE PERMITTEE SHALL INSURE <br />THAT THE RESOURCE IS PROPERLY EVALUATED IN TERMS OF THE NATIONAL HISTORIC <br />PLACES ELIGIBILITY CRITERIA (36 CFR 60.61). SHOULD A RESOURCE BE DETERMINED <br />ELIGIBLE FOR LISTING ON THE NATIONAL REGISTER, APPROPRIATE MITIGATION MEASURES <br />WILL BE DEVELOPED AND IMPLEMENTED IN CONSULTATION WITH THE STATE HISTORIC <br />PRESERVATION OFFICER (SHPO), THE BUREAU OF LAND MANAGEMENT (BLM), THE OFFICE <br />OF SURFACE MINING (OSM), AND THE MINED LAND RECLAMATION DIVISION (MLRD). <br />Mining operations proposed during the second permit term are within the area <br />encompassed by the previous archaeological surveys; therefore, no new <br />archaeological surveys will be required, except as provided for in Appendix <br />5-2 of the revised permit application. <br />Based upon a review of the information provided in the revised permit <br />application, the Division finds that the proposed mining operation will not <br />adversely affect any publicly owned park or place listed on the National <br />Register of Historic Places. <br />With the continued acceptance of the above stipulation, the operation is in <br />compliance with the requirements of this section. <br />IV. Geology - Rules 2.04.5 and 2.04.6. <br />Detailed discussions concerning the geology of the Seneca II Mine site and the <br />geochemistry of the overburden, interburden and coal may be found in Volume <br />II, Tab 6 of the original permit application and in the permit renewal Second <br />Adequacy Review responses. <br />The Seneca II Mine site is located on the Tow Creek anticline, a local <br />structure within the regional Sand Wash structural basin of northwestern <br />Colorado and south central Wyoming. <br />Exposed strata near the mine site vary in age from late Cretaceous to <br />Quaternary. Most units in the area are marine and non-marine sediments, <br />however, some T4iocene extrusives are locally present. <br />-B- <br />
