Colorado 81626 <br />DECISIOP <br />Lease Snseeaeion Cranted <br />On August 25, 1987, Empire Energy Corporation applied for a suspension of <br />operations and production on coal lease D-OS6298 purawne to Section 39 of <br />the Mimral Leasing Act of 1920 (MLA), as seceded, and the i¢plenantiag <br />regulations at 43 CPH 3483. <br />Empire Hmrgy has developed federal coal lease D-056298 according to the <br />approved Basouree Recovery end Protection PLa for the Hagle Ro. S Miw. , <br />To data, approzimataly 258,000 tone of coal have bean removed by <br />underground sluing methods from the F seem oa the leas, ezhaaating the P <br />seam recoverable reserves. Additional reserves, nlso controlled by Empire <br />Haergy, are contained in loner seaas on the lease. Bmpire currently mesa <br />this lease for access to anderground coal reserves contained is the P wsm ' <br />on ad~aeant federal and private lasses. Under the approved Basourca <br />Eecovery and Protection Plan, up to three pillion tone of coal sny be •. <br />tranaposted through thin levee annually to Empire's surface faeilitiea. <br />Accordingly, tM lease suspenalon requested by Empire Emrgy is hereby <br />granted for a period of four years effective ae of October 7, 1987, <br />sub~act to raeertifieation ae required by stipulation 3 of this decision. <br />Thin suspension say be reneved until such tine sa the access provided by <br />D-056298 is no longer mceasary to recover reserves located io the P seen <br />on adjacent areas.
