Arizona 86001 <br />1602) 7745253 <br />Mr. Carl Mount <br />Colorado Mined Land Reclamation Division <br />1313 Sherman Street, Rm. 215 <br />Denver, CO 80203 <br />RE: April 25, 1989 CMLRD Letter Regarding 1989 Seed Mixes <br />and Annual Shrub and Tree Planting Map, Seneca II Mine, <br />Permit C-80-005 <br />Dear Mr. Mount: <br />Regarding your request for correlation between the "1989 <br />Seeding and Shrub and Tree Planting Areas" map (as submitted <br />with letter on April 12, 1989) and Exhibit 13-2, <br />"Reclamation Plan Map", we would like to clarify the uses of <br />these maps. The two maps do not reflect similar situations. <br />Exhibit 13-2 reflects grading, not final topsoiling and <br />revegetation activities. Indeed, Rule 4.14~.1(1~ provides <br />the basis for generation of Exhibit 13-2. The "1989 Seeding <br />and Shrub and Tree Planting Plan" map was generated to show <br />the actual minimum area to be revegetated by fall 1989, <br />which also corresponds to the minimum area to be considered <br />for concentrated shrub seedings. The anticipated areas for <br />planting of shrub and tree seedlings are also shown on this <br />map. <br />There is no permit requirement to project by year which <br />areas are to be topsoiled and seeded. However, Peabody must <br />submit to the Division a list of the proposed seed mixes to <br />be used in revegetation for a given year and an annual <br />planning map to show the approximate locations of the shrub <br />and aspen plantings for that year. Again, these two <br />requirements do not include showing all areas to be <br />revegetated in a given year. As you know, there are a <br />number of factors which may control the actual acres <br />topsoiled and seeded in any given year. These include <br />climatic conditions, operational considerations, equipment <br />and personnel availability, and availability of plant <br />materials. As an example, the areas shown on the 1989 <br />planting plan map reflect what Roy Karo (Reclamation <br />Supervisor at Seneca) feels is the minimum acreage that can <br />realistically be revegetated based on the anticipated <br />commitment of personnel and equipment for the construction <br />of the tie-across haul road and opening of the Seneca I]-W <br />Mine property during the remainder of 1989.
