From our recent telephone <br />conversations, you are aware that the Division plans to demolish and remove the <br />two concrete coal silos located on the Hawk a Nest site. These silos were owned <br />by Western Slope Carbon Inc. as part of the Hawk's Nest coal mining operation. <br />According to our files, Mountain Coal Company acquired the two concrete silos and <br />overhead conveyor from the Denver Rio Grande Western Railroad. <br />Correspondence between the Division and ARCO has revealed that ARCO is no longer <br />interested in permitting the silos for the West Elk Mine. The Division is <br />requesting that ARCO make a decision regarding the possible use and permitting <br />of the silos and submit this decision in writing to the Division. Should ARCO <br />determine that it will not put the silos to use, please indicated in the letter <br />that ARCO consents to demolition and removal of these structures by the State of <br />Colorado and its Contractors. The attorney for the Department of Natural <br />Resources requests that this letter be signed by the president of ARCO Coal <br />Company or two Corporate Officers. <br />If Mountain Coal Company wishes to salvage the truck dump scale or overhead <br />conveyor prior to demolition and reclamation of the Bite, please notify the <br />Division of this decision in the letter. <br />If you have any questions or need additional information, please do not hesitate <br />to contact me at 866-3567. <br />Sincerely, <br />~~~ 5. <br />Erica S.
