Lang <br />Division Director <br />Thank you for your recent telephone call regarding information about the Golden Eagle <br />underground coal mine in Las Animas County, Colorado. I wanted to take this <br />opportunity to provide a response. <br />I've made a copy of a section of Basin Resources' "Surface Ownership" map, revised <br />June 5, 1995, for your benefit. On this copy, I've identified your Rancho Escondido <br />property (parcel No. 4/C-32) with red diagonal lines. I've further identified the currently <br />approved mine permit boundary for the Golden Eagle mine (heavy black dashed line), <br />the currently approved extent of the underground mine workings (yellow), and Colorado <br />State Highway No. 12 (red dashed line). <br />Based on this map, which has a scale of one inch = 2,000 feet, the current distance <br />(black arrows) between the southern limit of your property and the Golden Eagle mine's <br />approved extent of underground workings is approximately 8,000 feet. <br />You mentioned that Basin Resources has provided you notification in writing that your <br />property may be subsided in the future. At this time, the Golden Eagle Mine permit <br />boundary lies approximately 4,800 feet south of the southern limit of your property. <br />Until such time as Basin Resources receives approval of an application to expand their <br />current boundary, Basin Resources may not mine beyond their currently-approved limit. <br />Basin Resources is, as you mentioned, currently conducting exploration drilling in the <br />vicinity of your property. This activity, also currently approved by our Division, occurs <br />under a permit separate from their mining permit. <br />STATE OF COLORADO <br />You mentioned that Basin Resources has advised you that as your property may be <br />undermined in the future, you should consider waiting several years before building any <br />structures on your property to avoid having those structures damaged by underground <br />
