11. CRITERIA AND SCHEDULE FOR BOND RELEASE <br /> Rule 3.03.1(2)(a) states. "Up to sixty percent of the applicable bond amount shall be released <br /> when the permittee successfully completes backfilling, regrading, and drainage control in <br /> accordance with the approved reclamation plan." With regard to this Phase 1 bond release, the <br /> approved reclamation plan for the Edna Mine calls for reclamation of the road system to the <br /> premining configuration. The North Road was to be reduced in width to a maximum of 40 feet. <br /> The configuration of Skyline Drive was unchanged. The Lower Moffat Road and the West <br /> Ridge road were to be reduced in width to a maximum of 20 feet. The Middle Moffat Road <br /> was to be removed and graded to blend in with adjacent topography. <br /> The remaining facilities: the grizzly pad, explosives magazine/facilities pond, power line <br /> corridor,bond yard and utility road were to be removed and the areas graded to blend in with <br /> the surrounding topography. <br /> The three permanent impoundments are the West Ridge,Center Ridge and Moffat ponds. The <br /> West Ridge and Center Ridge ponds were constructed during the interim period and were <br /> constructed according to those standards. The Moffat Area Pond was constructed in <br /> accordance with the permanent program design standards. <br /> III. OBSERVATION AND FINDINGS <br /> P&M has applied for Phase I bond release on 258.0 acres for several facilities. The location <br /> of the Facilities requested for release are shown on Exhibit 1 of the bond release application. <br /> The approved post-mining topography map is found in Exhibit 3.4-1 and associated exhibits <br /> are found in Section 3.5 of the permit application for the roads, and Section 4.6 for the <br /> sediment ponds. <br /> An inspection of the facilities was conducted on November 17, 1999. All facilities had been <br /> graded to blend in with the adjacent reclaimed topography. The grizzly pad was constructed <br /> in pre-law mine disturbance. The area has been graded to blend in with the surrounding <br /> terrain and seeded. The explosives magazine/facilities pond area were also constructed in <br /> pre-law disturbance. This area has been graded to blend in with surrounding disturbance, <br /> partially topsoiled and seeded. All of these areas drain into the Center Ridge pond. <br /> The powerline corridor and bone-yard have been regraded to blend in with the adjacent <br /> terrain. These areas have been topsoiled and seeded. Drainage flows into the Moffat Area <br /> pond. <br /> Roads have been reduced in width as required by the permit application. Drainage control <br /> on the retained roads has been accomplished using ditches and culverts as approved. The <br /> roads have been well maintained.
