After hearing all of the presentations by the parties <br />and by the Division, and after hearing public comment, the Board <br />finds that the application is complete and that the recommendation <br />of the Division to approve the application with certain conditions, <br />as amended by the Board, sufficiently addresses the issues raised <br />by this matter. Sae $ 74-32-115, C.R.S. (1984 & 1993 Supp.). The <br />Board therefore grants the application for amendment with the <br />following conditions: ~ ~. 17-~i~a~ <br />a. Southdown will submit the final Cultural )~q q <br />Resource Management Plan to the Division before any activity can <br />begin on the site. ' <br />b. Southdown will submit the results of the black- ~ eT~ <br />footed Ferret study to the Division and obtain Division approval to l-~-qs <br />proceed before any activity can begin on the site. <br />c. Southdown will not disturb the 4th Ridge area <br />until acid-base neutralization tests are run on a representative <br />group oP samples from the pyritic rock material to be mined or <br />exposed in this area. A separate remediation plan must be approved <br />by the Division which prevents potential acid mine drainage before <br />any activity can begin on the site. <br />d. Southdown will, before any blasting is done, /fir <br />complete pre-blast surveys for owners of adjacent structures that KJ <br />want surveys and may be affected by blasting at the mine in . <br />accordance with OSM requirements as presented in the "Blasting 3'~ <br />Guidance Manual." The operator shall notify such owners and <br />provide proof of notification to the Division. Southdown will <br />also propose a blast monitoring plan which stipulates: (1) what <br />monitoring will be done and how often, (2) the area where pre-blast <br />surveys will be conducted and (3) xhat blast monitoring summary <br />report format will be used. The blast monitoring plan and included <br />stipulations must be approved by the Division before any blasting <br />can begin on the site. <br />e. The Division must receive copies of all signed <br />letters from all owners of structures within 200 Peet of the <br />affected area boundary as to who is responsible Por any damage <br />sustained to the structures as a result of the mining operation. <br />Alternatively, the operator may provide an engineering study that <br />demonstrates to the satisfaction of the Division that the mining <br />operation will not~~..//--ad,~versely, affect the stabili~ty/ ofr such <br />StrYCtures. ~ ~C, J/2.+Ci -7 N ~ ~~ ~ ~ ~a v[ ~.~.~ ~ /'-r o 4~'^~~b~ <br />~~--.~ <br />
