After hearing all of the presentations by the parties and by the Division, and after hearing public comment, the Board finds that the application is complete and that the recommendation of the Division to approve the application with certain conditions, as amended by the Board, sufficiently addresses the issues raised by this matter. Sae $ 74-32-115, C.R.S. (1984 & 1993 Supp.). The Board therefore grants the application for amendment with the following conditions: ~ ~. 17-~i~a~ a. Southdown will submit the final Cultural )~q q Resource Management Plan to the Division before any activity can begin on the site. ' b. Southdown will submit the results of the black- ~ eT~ footed Ferret study to the Division and obtain Division approval to l-~-qs proceed before any activity can begin on the site. c. Southdown will not disturb the 4th Ridge area until acid-base neutralization tests are run on a representative group oP samples from the pyritic rock material to be mined or exposed in this area. A separate remediation plan must be approved by the Division which prevents potential acid mine drainage before any activity can begin on the site. d. Southdown will, before any blasting is done, /fir complete pre-blast surveys for owners of adjacent structures that KJ want surveys and may be affected by blasting at the mine in . accordance with OSM requirements as presented in the "Blasting 3'~ Guidance Manual." The operator shall notify such owners and provide proof of notification to the Division. Southdown will also propose a blast monitoring plan which stipulates: (1) what monitoring will be done and how often, (2) the area where pre-blast surveys will be conducted and (3) xhat blast monitoring summary report format will be used. The blast monitoring plan and included stipulations must be approved by the Division before any blasting can begin on the site. e. The Division must receive copies of all signed letters from all owners of structures within 200 Peet of the affected area boundary as to who is responsible Por any damage sustained to the structures as a result of the mining operation.
