Box 1030 <br />Paonia, Colorado 81428 <br />RE: Upper Hubbard Creek Site Reclamation <br />Dear Mr. Ward: <br />Thank you for taking time last Thursday, June 1, 1995, to visit <br />the Upper Hubbard Creek Site with me. As we discussed Somerset <br />Mining Company is planning the possible use of the site for it's <br />original intended purpose, as a ventilation facility for coal <br />reserves in the Hubbard Creek area. Those reserves would <br />probably not be developed until mining has been completed in the <br />Sanborn East Tract, and is likely to be at least ten years from <br />now. <br />However, since the pad, sedimentation pond, and power line have <br />already been constructed at the site, SMC considers total <br />reclamation of the site at this time to be a waste of resources. <br />The site has been stabilized and vegetated since construction <br />approximately ten years ago. <br />Last year, SMC removed the fence from the site to allow public <br />use of the pad as a trail-head parking facility for the Forest <br />Service property on the north portion of the pad, as required in <br />the reclamation plan. SMC plans to leave the south portion of <br />the pad as part of the trail-head parking facility, until such <br />time as a ventilation facility would be required. <br />SMC is currently working with the Bureau of Land Management to <br />convey an easement across SMC property for the power line access <br />road. When the easement has been finalized, SMC will submit a <br />revision to the Colorado Division of Minerals and Geology for the <br />reclamation plans for Upper and Lower Hubbard Creek Sites, and <br />the power line and power line access road. <br />In response to your concerns regarding Delta County Road access <br />and the road around the pad site, I called Ralph Clark to verify <br />what Delta County considers their right of way. Ralph said they <br />maintain the graveled portion of the road to the pad, and agrees <br />with your suggestion to block the dirt road around the toe of the <br />pad. When we are able to schedule equipment and labor to the <br />site, we will block the dirt road with large boulders and reseed <br />the dirt roadway. <br />P.O.
