Box 58 <br />Delta, Colorado 81416 <br />RE: Notice of Intent for Lennox htesa Exploration Site <br />Dear Mr. Collins: <br />The Division has received Grand Mesa Properties' Notice of Intent for the <br />Lennox Mesa exploration site located in portions of sections 19 and 30, <br />T135 R90W, and portions of sections 23 and 24, T135 R91W, 6th P.M. As you <br />have been previously notified, the Division has determined that the pro- <br />posed exploration activities in this area constitutes a substantial distur- <br />bance to the natural land surface, and as such the operation must comply <br />with the performance standards of rule 4.21 and must be bonded prior to <br />initiation of exploration for the total estimated cost of reclamation. In <br />addition, the Division has identified the following concerns upon review <br />of the Notice of Intent which must be adequately addressed before the <br />Notice can be issued. <br />1. In order to verify Grand Mesa Properties' legal right to enter the <br />proposed exploration area, the Division will need a copy of that portion <br />of the lease option document referred to in the Notice of Intent which <br />grants Grand Mesa Properties permission to enter the area. <br />2. The Notice of Intent indicates that all contemplated exploration <br />activities will be conducted on or adjacent to existing roads or other <br />previous disturbances. The applicant needs to describe which specific <br />exploration activities will be conducted on areas adjacent to the ex- <br />isting roads and whether these activities will create new surface distur- <br />bances. If new surface disturbances will be created, the applicant must <br />describe the nature and extent of the disturbance. In addition, the appli- <br />cant needs to provide a description of the previously disturbed areas in <br />which exploration activities will take place, and the nature and extent <br />of new disturbances which will be created in these areas. <br />
