•- <br />-g- <br />X. Bonding -Rules 2.05.4 (2)(b) and 3 <br />Sundance Coal Company has submitted calculations for reclamation costs of al] <br />current mine related disturbance and facilities. The Division has determ'iined <br />that this amount will be sufficient to cover the cost of reclamation at the <br />Animas Mine as it exists during this period of temporary cessation. The <br />amount of bond to be submitted is $146,643.00. <br />Pursuant to Rules 2.07.6(2)(j) and 3.02.1(1), the performance bond in this <br />amount will be filed with the Division, payable to the State of Colorado,, <br />before permit approval will be issued and before current bonds will be <br />returned. <br />The operation is in compliance with the requirements of this section. <br />XI. Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.19, <br />4.21, 4.28, and 4.30 <br />The applicant has submitted a suitable letter and is meeting the requirements <br />of Rule 4.30 concerning temporary cession of operations. <br />The operation is in compliance with the requirements of these sections. <br />XII. Operations on Lands Sub.iect to Prohibitions or Limitations - <br />The operation is in compliance with the requirements of these sections and <br />Rule 2.07.6(2) (d) for the following reasons: <br />1. The permit area of the operation is not within: <br />a. an area designated unsuitable for mining; <br />b. an area under study for designation as unsuitable for surface coal <br />mining; or <br />c. on any lands subject to prohibitions or limitations. <br />2. The permit area of the operation is within 300 feet of an occupied <br />dwelling, but the applicant has submitted the documentation required by <br />Rule 2.07.6(2) (d) (v). <br />VIII. Demonstration that Surface Coal Mining and Reclamation Operations <br />Pursuant to Rule 2.07.6(2) (b), the Division finds that surface coal mining <br />and reclamation operations can be feasibly accomplished under the mining and <br />reclamation plan. <br />XIV. Compatibility With Anticipated Ad.iacent Operations - <br />Pursuant to Rule 2.07.6(2) (i), the Division finds that Sundance Coal Company <br />operations are not inconsistent with any other operations anticipated to be <br />performed in areas adjacent to the permit area. ~~ <br />W; ~ ~~ <br />,. ~ ~~d~l, ^k.~l <br />!~ <br />
