Watcher <br />Executive Director <br />Ronald W. Cottony <br />Acting Division Director <br />The Division of Minerals and Geology received a request for inspection on May 23, 2002. We <br />conducted our inspection on May 24, 2002. We have prepazed the attached report in response to <br />this request. <br />Based upon our investigation and evaluation, we did not find evidence clearly indicating that the <br />cause of the rockfall onto State Highway 12 that occurred on May 23, 2002 was directly related to <br />the blasts from the Lorencito Canyon mine that were the subject of the review. <br />We have, however, concluded that surface blasting operations conducted during the blasts <br />reviewed were not fully in compliance with the approved DMG permit, the Colorado Surface Coal <br />Mining Reclamation Act (Act}, and the Regulations of the Colorado Mined Land Reclamation <br />Boazd for Coal Mining (Regulations). <br />We have therefore issued via a separate letter a Notice of Violation to Lorencito Coal Company <br />for failure to conduct surface blasting operations at the Lorencito Canyon mine in accordance with <br />the Act, the Regulations, and the approved DMG permit. <br />Sincerely, <br />DanDan/Hemand~ <br />Senior Environmental Protection Specialist <br />Cc: David A.
