NAI2I2ATIVE <br />BACKGROUND <br />Applicant, Dillon Ranches LLLP, is the owner ofParcel SS97-1 S 1-00-8001ocated within the Animas <br />Valley Land Use Plan. The total parcel consists of 170f acres (classified as 6S acres industrial and <br />lOS acres agricultural). A portion of the parcel is currently leased to Sandco, Inc. for its sand and <br />gravel operation which is located in the designated Industrial Zone within the Lane Use Plan. <br />Applicant's proposal for a map amendment is to build a small lake of approximately 44t surface <br />acres in what is mostly located inthe NW/4NW/4 of Section 14 with smaller portions extending into <br />the NE/4NE/4 of Sections 1 S; the SE/4SE/4 of Section 10; and SW/4SW/4 of Section I 1 as shown <br />on the accompanying plat. The lake will be used in conjunction with a long term plan to develop <br />the property in one or more pazcels consistent with the Animas Valley Land Use Plan. If divided <br />into more than one parcel, the lake yvill be dedicated as a common element to such separate pazcels. <br />It is also anticipated that when completed, the lake and certain portions of the surrounding lands <br />along the perimeters of the lake may be dedicated as a conservation easement to La Plata Open Space <br />Conservancy or its successor. <br />Excavation of the lake as hereinafter set out under Operational Procedures will commence on the <br />East side of the Animas River a distance of at least 300 feet from the bank to assure stabilization of <br />the river bank. <br />The Applicant has obtained a well permit for intercepting ground water and has irrigation water <br />rights for the property, a portion of which rights may be converted into a storage water right, if <br />necessary. These water rights consist of 38 shares (20 A shazes and 18 B shares) in the Animas <br />Valley Ditch Company (equivalent to 2.375 c.f.s.) For the construction of the proposed lake, <br />Applicant has a contractual relationship with Sandco, Inc. to receive the extracted aggregate that will <br />be excavated in order to create the lake. Sandco or the Applicant will obtain an access crossing <br />permit into the Animas River for Sandco's sand and gravel operation. Such access will be used to <br />cross the river during certain times of the yeaz, namely between September ls' and April 1S"' as <br />allowed the U.S. Army Corps of Engineers. <br />The principals of Sandco, Inc. are also the principals of the Applicant. Sandco, Inc.'s gravel <br />operation lies within the existing industrial zone as one of the sand and gravel operations allowed <br />in the Animas Valley. It is not anticipated that Sandco will change its method of operation other <br />than extracting the aggregate from the area where the lake is to be constructed, as opposed to <br />extracting aggregate materials from the river. Because of the size of Sandco's sand and gravel <br />operation, it has limited capacity to store raw materials on its 16.6 acre processing yard. Because <br />of this limitation, it is anticipated that the construction of the lake may take several yeazs to <br />complete. <br />
