ROOM 104 <br />August 18, 1999 TRINIDAD, COLORADO 61082 <br />Mr. Jim Tatum <br />Jim Tatum & Associates <br />8703 Bonhomme <br />Houston, TX 77074 <br />Dear Mr. Tatum: <br />In response to your letter dated today, I hereby verify to <br />you that I did not at any time say to Mr. Lopez of Basin <br />Resources that I saw no fugitive emissions from the hauling <br />operation. Mr. Lopez"a statement to that effect is totally <br />untrue. <br />I did meet with Mr. Lopez about the coal duet problem and we <br />discussed this subject in great detail. Mr. Lopez was of <br />the opinion that since a truck had spilled a load of coal on <br />the Highway that this was what had created the dust problem. <br />I informed Mr. Lopez that this problem had existed for over <br />two years and moat certainly was not caused by one truck <br />spilling a load of coal. <br />Basin Resources have covered their trucks to prevent dust <br />from blowing out onto the Highway. However, this procedure <br />did not work and the only logical conclusion is that the <br />coal duet problem is coming from the trucks and not just <br />from the loads of coal. <br />I waa assured that Basin Resources would start washing the <br />trucks before they left the mine. To this date, I do not <br />know if this practice is being done. I do know that the <br />coal duet problem still exists and, in my opinion, is a <br />traffic hazard. <br />I am not sure if I informed the State about this letter. I <br />did inform Mr. Dan Hernandez, Division of Minerals and <br />Geology about my opinions regarding this problem. If you <br />have any additional questions, please give me a call. <br />Michael A.
