Stipulation No. 5 of the Proposed Decision stated: <br />A PERFORMANCE BOND IN THE AMOUNT OF $7,580,933.00, <br />PAYABLE TO THE STATE OF COLORADO AND THE UNITED <br />STATES OF AMERICA, MUST BE FILED WITH THE DIVISION <br />WITHIN FIVE DAYS AFTER THE DECISION BECOMES FINAL. <br />P&M and the Division agree that the amount of the <br />performance bond shall be the sum of $7,121,196.00. This amount <br />was calculated as follows: <br />(a) Worst Case Year as shown in <br />Application for Permit Renewal $ 6,931,486 <br />(bl Cost of reseeding previously <br />mined/affected areas on West <br />Ridge not included in the Worst <br />Case Year computation: <br />430.12 acres 0 $272.84/acre $ 117,354 <br />(c) Indirect costs associated with <br />reseeding $ 72,356 <br />The Division agrees that P&M may either post a new <br />performance bond in the required amount or increase the present <br />performance bond (No. U80 bl 57-27) to the required amount, at <br />P&M's option. <br />The Division further agrees that the South of Shop Area <br />is not to be included in the performance bond required for the <br />Permit Renewal. P&M agrees to submit to the Division for approval <br />a reclamation plan far the South of Shop Slide Area (approximately <br />-9- <br />
