In May, 2001, <br /> a 43 CFR 3809 field compliance inspection was conducted on the above mentioned <br /> mining plan of operations. As in previous reports, the inspection found <br /> various unused and unnecessary equipment and buildings being stored on public <br /> land. Given the present condition of said equipment, it is quite apparent <br /> that they have not been used in the operation on your project for many, many <br /> years. Mining and Minerals II, Ltd. was given authorization on a plan <br /> amendment in 1998, and to date no work, as approved, has been conducted. The <br /> Joker Mine operation is hereby classified as inactive and the time for <br /> completing all public surface reclamation requirements has now come due. <br /> At 43 CFR Sec. 3809. 424 (2) under the existing regulations, implemented January <br /> 20, 2001 , it states that: <br /> If the period of non-operation is likely to cause unnecessary or undue <br /> degradation, then BLM will require you to take all necessary actions to <br /> assure that unnecessary or undue degradation does not occur, including <br /> requiring you, after an extended period of non-operation for nther than <br /> seasonal operations, to remove all structures, equipment, and other <br /> facilities and reclaim the project area. <br /> Under the previous 43 CFR 3809 regulations at 3809. 3-7. it states that : <br /> All operators shall maintain the site, structures and other facilities <br /> of the operations in a safe and clean condition during any non-operating <br /> periods. All operators may be required, after an extended period of <br /> non-operation for other than seasonal operations, to remove all <br /> structures, equipment, and other facilities and reclaim the site of <br /> operations, unless he/she receives permission, in writing, from the <br /> authorized officer to do otherwise. <br /> Because you are not using any of this equipment in question, you are hereby <br /> required to comply with the 43 CFP 3809 regulations and remove all unused, <br /> unnecessary equipment and buildings.
