However, the southerly extent of that berm does not <br />adequately exclude the water from the reclamation area. There is <br />probably less than one foot of elevation of the berm between the dirty <br />water and the fresh water channels at the southerly end, which i.s the <br />point where the drainage from the disturbed area crossed into the clean <br />water diversion ditch resulting in NOV C-92-017 originall}•. <br />We believe that Harrison Western has not removed enough sediment from <br />the pond to significantly enlarge its capacity. They have created <br />several stockpiles of the sediment, some of which are on the access <br />road, completely blocking any access on that road.
