We discussed in part some questions that Western Fuels- <br />Colorado (WFC) raised with regard to their operations at the New Horizon Mine (C-81-008) near <br />Nucla, Colorado. WFC had specifically asked DMG for some guidance with regard to Rules <br />4.08.4(4) and 4.08.4(l0)(b). <br />Rule 4.08.4(4) states. <br />"A resident or owner of a dwelling or structure that is located within one-half mile of <br />any azea affected by surface blasting activities shall be notified no less than 24 hours <br />prior to any surface blasting or less frequency as each resident occupant in such areas <br />shall approve in writing to the Division." <br />WFC, according [o Ross Gubka, regularly attempts to contact two families near their mine, <br />the Reeders and the Garretts, incompliance with [his rule. According to Ross, Mr. and Mrs. <br />Reeder both work during the day, and do not have a telephone answering system at their <br />home. Mr. Gubka wondered if logging an attempt to contact the Reeder family at home was <br />sufficient for the purpose of complying with Rule 4.08.4(4), or if actual direct contact with <br />either Mr. or Mrs. Reeder needed to be achieved. <br />Ms. Linden suggested that WFC contact the Reeder family, and ask the Reeder family <br />(probably in writing) how the Reeders would like WFC to contact them.
