/4 . <br />Coal Ridge No. 1 Mine <br />C-84-065 <br />Decision and Findings of Compliance <br />for <br />Transfer of Permit <br />Colorado Mined Land Reclamation Division <br />July 10, 1991 <br />The Colorado Mined Land Reclamation Division has issued a decision to approve <br />an application for transfer of the mining permit for the Coal Ridge No. 1 Mine. <br />This decision is based upon findings of compliance required by the Colorado <br />Mined Land Reclamation Act (SMCRA), C.R.S. 34-33-101 et. seq.., and the Rules <br />promulgated thereunder. <br />The necessary findings of compliance follow. <br />Information submitted in the transfer application pursuant to Rule 2.03.4 <br />is true and correct. <br />2. NCIG Financial, Inc. is eligible to receive a permit in accordance with <br />Rules 2.07.6(1>(b), 2.07.6(1)(c), and 2.07.6(2). <br />Standard inquiries were made pursuant to C.R.S. 34-33-114(3) and the <br />Applicant Violator System during the transfer application review process. <br />No other states were contacted as NCIG Financial, Inc. or its officers <br />have never operated any previous coal mining activities. <br />Information supplied by NCIG Financial, Inc. has demonstrated an intent <br />to comply with the requirements of 30 CFR Chapter VII,Subchapter R, the <br />Surface Coal Mining Reclamation Act, and Regulations promulgated pursuant <br />to the Act. <br />Based upon the available information, the Division finds that NCIG <br />Financial, Inc. will conduct operations at the Coal Ridge No, 1 Mine in <br />accordance with the Act and the Regulations and the approved permit. <br />3. The performance bond in the form of three certificates of deposit and in <br />the amount of $288,000 has been transferred from New Castle Energy <br />Corporation to NCIG Financial, Inc. The amount is deemed sufficient to <br />assure reclamation of all site disturbance. <br />6900F/ ldc <br />
