<br />The National Response Center <br />December 2, 1998 <br />Page 3 <br />The company is committed to taking the steps and spending the money to ensure <br />[hat resulting environmental impacts (if any) will be promptly cured, and that <br />something like this will not happen again. Fortunately, 2,4-D is a substance of <br />relatively low toxicity which degrades very quickly in the envirorunent, with a <br />half-life in soils generally estimated at days or weeks. <br />2. Ms. ,Iohanna Miller, On-Site Emergency Coordinator for EPA; Region VIII. <br />requested B&B to work with an appropriate state agency to address further <br />investigation and remediation of the spilled weed-killer. Thus, B&B informed the <br />Colorado Division of Minerals and Geology ("DMG") of the spill, and the DMG <br />Itas now conducted an onsite inspection of the Montgomery Pit facility <br />(November 16, 1998), and issued an Inspection Report mandating certain site <br />characterization, remediation. and corrective measures. B&B has committed to <br />work with DMG to implement the requirements of the Inspection Report, and <br />B&B intends to conduct any cleanup needed, in full cooperation with and under <br />the supervision of DMG, on the fastest feasible basis. Finally, we want [o point <br />out the following language in DMG's Inspection Report, which we third: <br />accurately describes the way B&B has responded to [he situation: <br />"The Division is satisfied that B&B Excavating has taken <br />all prudent measures to this point to quickly assess and <br />correct any environmental or health problems that may <br />have been caused by the loss of containment of the <br />herbicide. By immediately reporting the incident to <br />regulatory agencies, by shutting down the asphalt operation <br />at the Montgomery Pit, and by bringing a qualified <br />contractor onsite to conduct an evaluation, B&B <br />management has done everything they could to contain the <br />potential impacts." <br />B&B has briefed all supervisors (and through them all employees) on the <br />importance of environmental compliance and following good envirommental <br />practices at all times, and is in the process of considering further environmental <br />training and corporate policies to help ensure that such a situation will no[ <br />reoccur. <br />4. Various drums formerly located at the Montgomery Pit facility, including the five <br />drums involved in the two incidents described above, have been tested, <br />characterized, and removed from the site for disposal by Safety Kleen in <br />accordance with applicable laws and regulations. <br />
