acres of disturbance) to which the Phase I bond release applies is contained mostly in Section 17 <br />and small portions of Sections 8 and 16 of Township 5 North, Range 87 West. The location of <br />the bond release area is shown on Exhibit A - Phase I Bond Request Areas of the bond release <br />application. <br />An application for Phase I bond release was received by the Division on July 28, 2006. The <br />application was deemed complete on September 13, 2006, after the Division received proof of <br />publication of the applicant's public notice. Seneca Coal Company published notice of the bond <br />release application in Steamboat Pilot once weekly for four consecutive weeks, beginning July <br />23, 2006. Seneca Coal Company also notified land owners within and adjacent to the mine <br />permit azea, and other interested parties of the application for bond release, as required by Rule <br />3.03.2(1). <br />No comments, written objections, or requests for an informal conference regazding the bond <br />release application were received by the Division. <br />The Division scheduled and conducted a bond release inspection on October 4, 2006. The site <br />inspection was conducted in accordance with Rule 3.03.2(2). Mr. Mike Boulay of the Division, <br />Ms. Jennifer Maiolo of the Bureau of Land Management (BLM) from the Craig, Colorado office <br />and Mr. Roy Kazo of Seneca Coal Company (SCC) attended the inspection. Both the BLM and <br />SCC are legal land owners of record of the surface within the permit boundary. None of the <br />other land owners of record attended the inspection; however, all land owners were notified of <br />the inspection via certified mail. <br />Adequacy questions and concerns raised by the Division during the inspection are detailed in the <br />Division inspection report dated October 18, 2006 and aze summarized below in Section III of <br />this document. There were no sepazate adequacy correspondence letters sent to Seneca Coal <br />Company. <br />
