Several preceding correspondence
materials were also reviewed. I have also discussed the methane
related issues with Joe Nugent,
First, since there is no specific request for an inspection, and the
letter does not appear to constitute a formal citizen's complaint, I
recommend that we hold our response until Renner can become involved.
We may want our A.G. representative involved with our response.
A few additional comments follow. Our previous response regarding the
trees in the area is both clear and appropriate. Joe Nugent assures
me that an above ground methane explosion is highly improbable, and
that the referenced Texas incident involved very different
circumstances than are involved at the Golden Eagle Mine. The well
issue should be investigated by our staff, and as part of that
investigation more information will probably be requested of
Mr. Tatum. Finally, I recommend that our staff continue to research
such permitting and compliance issues as surface/mineral ownership
information accuracy, mine plan and subsidence projections and
associated approved mitigation provisions. If plan or practice
omission are identified, then appropriate permitting and/or
enforcement procedures must be pursued.
/ern
cc: Steve Renner
Joe Dudash
m:\oss\ern\tatum
