ACTIVITIES AT THE RAW COAL LOADOUT OR DISTURB IN ANY WAY THE <br /> AREA IDENTIFIED AS 5LA7186 AS DEPICTED ON FIGURE 2 OF 3, CULTURAL <br /> RESOURCE SITES AND SURVEY AREAS PRIOR TO THE COMPLETION OF <br /> THE TREATMENT PLAN AND RECEIPT OF SHPO CLEARANCE. <br /> (see response to stipulation no. 1 above) This stipulation was also complied <br /> with on November 10, 1997. <br /> Stipulation No. 4 <br /> LORENCITO COAL COMPANY SHALL CONDUCT CULTURAL RESOURCES <br /> SURVEYS, SUBMIT THE SURVEYS TO THE DIVISION, AND RECEIVE SHPO <br /> CLEARANCE PRIOR TO DISTURBANCE OR CONSTRUCTION ACTIVITIES <br /> ASSOCIATED WITHT THE P1/P2 HAUL ROAD, P1/P2 ACCESS ROAD, AND <br /> THE P1/P2 BOX CUT, PORTAL, AND TEMPORARY OVERBURDEN STOCKPILE <br /> AREA. <br /> Given the approved mine plan, the activities that would disturb the areas <br /> identified in stipulation no. 4 are part of the second five-year permit term. <br /> Therefore, this stipulation was issued with the original approval to be <br /> addressed during renewal of the permit. It remains an active stipulation. <br /> Stipulation No. 5 <br /> BY NOVEMBER 1, 1997, LORENCITO COAL COMPANY WILL SUBMIT A <br /> TECHNICAL REVISION TO THE PERMIT FOR PONDS 004, 006, 010, 011, 012, <br /> AND 013 TO ADEQUATELY RESPOND TO THE ISSUES OUTLINED IN <br /> QUESTIONS 147, 150 AND 151 OF THE DIVISION'S INITIAL ADEQUACY <br /> REVIEW (DATED MARCH 3, 1997), LLC RESPONSES, OR ANY SUBSEQUENT <br /> REVIEW AS DOCUMENTED. NONE OF THESE PONDS MAY BE <br /> CONSTRUCTED PRIOR TO FINAL DIVISION APPROVAL OF THE REVISION. <br /> Technical Revision No. 1 (TR-01) provided responses for stipulation no. 1, 2, 3, <br /> 5, and 9 that were issued with the original permit approval. Pond <br /> embankment conditions were reviewed and a report titled "Stability Evaluation, <br /> Small Sedimentation Embankments, Ponds 004, 006, 010, 011, 012, and 013, <br /> Lorencito Canyon Mine, Las Animas County, Colorado" was submitted and <br /> approved for incorporation into Exhibit 13 of the permit application. This <br /> stipulation was complied with on November 10, 1997. <br /> Stipulation No. 6 <br /> BY FEBRUARY 1, 1998, LORENCITO COAL COMPANY WILL SUBMIT A <br />
