C+ecernber 1. 20G3 ~+ppendix A <br />Page A-74 <br />Criterion 14: Riparian zones are present within the review area and are suitable for coal leasing <br />only with inclusion of the following special stipulations to protect resident and migratory bird <br />species: <br />A one-eighth mile buffer zone (660 ft.) will be protected on either side of Raven Gulch (or a <br />buffer zone may be established in accordance with the surface management agency <br />guidelines). No surface disturbances, except surface subsidence, will be permitted within <br />these buffer zones. All unavoidable surface disturbance will require approval of the USFS or <br />BLM's Authorized Officer. The BLM or USFS will coordinate with the Fish and Wildlife <br />Service and the CDOW to determine the type and extent of allowable variances. Asite- <br />specific analyses will determine if this stipulation will apply. <br />2. With respect to other raptors (except American kestrel) which may occur or become <br />established on the West Flatiron Tract during the life of the project, the following special <br />stipulation shall apply: <br />Conduct surveys for nesting raptors on the lease tract prior to development of any <br />surface facilities. No surface activities will be allowed within one-half mile radius of <br />active nest sites between the dates of February 1 and August 15, unless authorized <br />by BLM or USFS on asite-specific basis. <br />Criterion 15: If areas are determined by CDOW to be mule deer and elk crucial winter range, the <br />following stipulation shall be applied: <br />Coal related facilities and surface disturbances except subsidence will be authorized in the <br />review area only if no practical alternatives exist. The BLM and USFS will coordinate with the <br />CDOW to determine the type and extent of allowable variances. Coal exploration, facility <br />construction, and major scheduled maintenance will not be authorized within crucial winter <br />ranges from December 1 through April 30.
