Status of Other Required Permits. <br />- USF5. In issuing its Plan of Operations for Colorado Calumet the USFS is considering <br />Colorado Calumet, Crystaljack, and Glacier Peak together Unlike Teller County, the USFS <br />issues a Plan of Operations to the oper•ntor of the claims, not to the owner of the claims. At <br />the time Mr. Dorris became Operator of the Crystaljack claims in 2004, an amended Plan of <br />Operations covering both Crystaljack and Glacier Peak was issued. In December, 2005, <br />when Mr. Dorris also became the Colorado Calumet Operator, a new proposed Plan of <br />Operations for the three operations vas submitted, and in April 2006 the Forest Service <br />completed a drafr Environmental Assessment for them. Staff has attached as back-up to this <br />Staff Report the February USFS cover letter requesting input on the proposed Plan of <br />Operations, excerpts from [he April 2006 USFS draft Environmental Assessment, and June <br />19, 2006 correspondence with the USFS regarding minor changes to [he Environmental <br />Assessment to address certain concerns. <br />According to the letter dated January 19, 2006 from Brent Botts, District Ranger, contained in <br />Applicant's submittal, until the final Environmental Assessment and Plan of Operations for <br />all three claims are approved and signed, Applicant is authorized to operate under prior and <br />temporary Forest Service approvals with conditions as set forth in the letter specific to <br />Colorado Calumet. The USFS Decision Notice for the Environmental Assessment was <br />signed on June 7, 2006; however, no authorizations under it can proceed until the requisite 45 <br />day appeal period is over. When the 45 day appeal period is over and the required USFS <br />bond has been paid, the final Plan of Operations -five years (for all three operations) with an <br />additional five year extension based on review -- can then be signed (est: last week in July). <br />- DMG. While both Glacier Peak and Crystaljack already operate under DMG 110 <br />reclamation permits (IvL003030 and M1993030 respectively), a new reclamation permit was <br />required for Colorado Calumet. Application was made to DMG in March of this year: the <br />permit (M2006034) was apparently issued early in June. A copy of the application and other <br />DMG correspondence is included in the application package. Although DMG has issued its <br />reclamation permit, technically operations can not begin on the Colorado Calumet claims <br />unless and until the USFS Plan of Operations and the Teller County CUP are approved and <br />issued <br />Staffs recommended Conditions of approval allow for Administrative approval of non-substantive <br />amendments to this CUP in order to accommodate possible future non-substantive modifications of <br />the required Forest Service Plan of Operations and/or DMG reclamation permit. <br />2.
