<br />OWNER OR STATE -The Director of the State of Colorado, Division
<br />of Minerals and Geology (DMG) or his designee. The Colorado
<br />Crvisien cl Minerzls and Geology (DMG) is Iccated at 13:3 Sheman
<br />Street, Room 215, Denver, Calomtla, 60203, telephone (303) 666-
<br />3567.
<br />PROJECT MANAGER -The Diredor of the Colorado Division of
<br />Minerals and Geology or the DMG employee or representative
<br />responsible for day to day observation of projed work at the job site,
<br />and general contract administration for the DMG.
<br />4. INSURANCE
<br />The Contmdor is required to procure and maintain the insurance
<br />coverage listed below. Proof of insurance must be submitted on
<br />ceeificates shovncg'be lollcwing r.mimum coverage:
<br />Standard Workers Compensation and Employer Liability,
<br />as required by State Statute including occupational disease,
<br />covering all employees at the work site.
<br />2. General Liability (Public Liability 8 Property
<br />Damage)(Minimum):
<br />CONTRACTOR OR SELLER -The sole propretoship, partnership,
<br />or corporation to which the Purchase Order is adtlressed.
<br />PURCHASE ORDER CONTRACT DOCUMENTS - An enforceable
<br />contrad in that it is written evidence of the purchasers acceptance of
<br />the sellers previous and unretraded offer to perlortn the work subject
<br />of the pucnase order for the price stated therein. The Purchase
<br />Order Contend includes the Bitl, bid Schedule, General Conditions,
<br />Insurance Certificates, Purchase Order Terms and Conditions, Bid
<br />Solicitation Memorandum, including Work Description, maps,
<br />drawings and any Amendments These documents are
<br />complementary, what is called by for any one document shall be as
<br />binding as it called for by all.
<br />In wse of a difference between the contend tlocumems, precedence
<br />shall be given in the following respective orler. bid, Bid Solicitation
<br />memorandum, General Conditions, Purohase Order Tenn s and
<br />Conditions, maps and Drawings, Amendments shall take precedence
<br />in the area of the bid document which they modiry or clarify. In the
<br />case of any such difference, the matter shall be promptly brought to
<br />the attention of the PROJECT MANAGER who will make a
<br />determination in writing.
<br />WORK -The material and/or labor the seller is to famish to the
<br />purchaser by operation under the purchase order.
<br />SUBCONTRACTOR - A sole proprietorship, parmeship or
<br />corporation which has a contend with the CONTRACTOR tar the
<br />pertortnance Of labor at the site of the work regardless of whether
<br />supplying of material is part of such contend, but without contractual
<br />relationship to the purchaser.
<br />SUPPLIER - A sole proprietorship, partnership or corporation which
<br />over-V1e~ounter or under contend famished the CONTRACTOR
<br />matedal or equipment incorporated in the work br otherwise incident
<br />to tt1e CONTRACTOR'S pertortnance, but which pertortns no labor at
<br />Ne work site.
<br />2. CONDRIONS AFFECTING THE WORK
<br />In additlon to examining the drawings and specifications, completion
<br />schedule, and other insWCtions, bitltlers shall visit the site and take
<br />such oNer steps as may be reasonably necessary to ascertain the
<br />nature and location of the work, including average climatic conditions
<br />antl the general and local conditions which can atted the work or the
<br />cost thereof. Failure to do so will not relieve bidders from
<br />responsibility for estimating properly the difficulty or cost of
<br />successfully performing the work.
<br />3. AWARD
<br />Award will be made with reasonable promptness, by written notice to
<br />the low responsive antl responsible bidder whose bid meets the
<br />requirements antl criteria set forth in the Invitation for Bid. These

<br />'r.:CE, cortected if necessary for erors in price extension antl/or
<br />atlditidn, and capability to meet the peAOrmance time requirements.
<br />The GRAND TOTAL PRICE well be used for comparing bids only.
<br />a. Combined single limit of $600,000 written on an
<br /> occurrence basis;
<br />b. Any aggregate will not be less than S7 Million;
<br />c. The contractor must purchase additional
<br /> insurance if Gaims reduce the annual aggregate
<br /> below $600,000;
<br />d. The State of Colorado must be named as
<br /> additional insured on each comprehensive
<br /> general liability policy,
<br />e. Certificates of insurance must be provided to the
<br /> State within 70 working days after receipt of
<br /> Award; and.
<br />f. Insurance shall include provisions providing
<br /> notification to the State 10 days prior to
<br /> cancellation of the coverage.
<br />3. Automobile Liability (Minimum). The Contmdor must carry
<br />a minimum of $600,000 combined single limit.
<br />The State of Colorado MUST be named as an Addiaonal Insured on
<br />the certificate of insurance. An Additional Insuretl Endorsement
<br />amending such policy or polities must be presented to the DMG prior
<br />to issuance of the Notice to Proceetl. Bidders are advised to
<br />eonsuk with their insurance carrier concerning these
<br />requirements. Submtt a bid only H you are prepared tb complete
<br />these requirements.
<br />WORK SCHEDULE
<br />After a Purchase Order has been issued, the PROJECT MANAGER
<br />will notify the Contmdor. Under no tircumstances shall the
<br />CONTRACTOR begin work before a P.O. is issued. If the Bid
<br />Solicitation Memorandum specifies projed dates or a certain projed
<br />schedule, the successful bitlder shall peAOrtn the work during the
<br />specified time period. DMG reserves the tight to cancel the Purchase
<br />Order if the Contrador fails to begin the work as scheduled.
<br />ACCIDENT PREVENTION AND SAFEfY MEASURES
<br />The Contmdor shall comply with applicable provisions of OSHA Part
<br />1926, Construction Standards antl Interpretations, in etted on the
<br />date of the Bid Opening. The Contmdor shall continuously maintain,
<br />at his expense, adequate protection of the work and the Principle
<br />Representalive's property, and shall take all practicable precautions
<br />in the interest of safety.
<br />Any shafts which were fenced prior to construction activities shall be
<br />proteded by a temporary fence during non-working hours, without
<br />relieving the Contiador of its legal or contractual tluties to take safety
<br />precautions. Other openings may be designated by the Project
<br />Manager as requmng fencing due to proldmiry of houses or visitation
<br />by tourists.
<br />Work may involve activities around unproteded hazardous mine
<br />shahs, slopes. adits erd other opeor,gs which may be open to the
<br />sudace or hitlden Irom view by trash, debris, vegetation, or thin and
<br />unstable layers of surfidal materials or rock. The Contractor shall be
<br />responsible for thoroughly investigating the site conditions and
<br />scheduling and tlirecting his equipment, equipment operalions,
<br />personnel and safety procedures to prevent accidents and injures.
<br />Failure to comply will be cause for immediate suspension of the work.
