Box 591 <br />Somerset CO 81434 <br />Re: West Elk Mine (C-1980-007) Midterm Review <br />Deaz Mr. Bazbe: <br />The Division of Minerals and Geology has completed a midterm review of permit C- <br />1980-007 and materials associated therewith (the Permit Application Package) in <br />compliance with Rule 2.08.3(1) of the Colorado Surface Coal Mining Reclamation Act <br />and the Regulations of the Colorado Mined Land Reclamation Boazd for Coal Mining <br />(Rules). A copy of this midterm review is enclosed. A nluner of items appeaz to require <br />explanation, modification or correction. Please submit responses or any appropriate <br />changes (in the form of a Technical Revision or other appropriate mechanism) to the PAP <br />within ninety days of the date of this letter. <br />A recalculation of the reclamation bond was also accomplished as part of the midterm <br />review. The adjusted total is $11, 085,357.00.
