Stover & Associates E.ecmive Direc mr <br />2768 Compass Drive, Suite 101 Michael&LOng <br />Grand Junction, CO 81506 Division Director <br />RE: Diesel Fuel Spill; Terror Creek Company; Permit No. C-83-059 <br />Dear Mr. Stover; <br />The Division has reviewed the letter regarding the actions taken by <br />Terror Creek Company (TCC) following the diesel fuel spill, which <br />occurred sometime during the weekend of May 13th and 14th. From <br />review of the Spill Prevention Control and Countermeasure Plan <br />(SPCC), it appears that TCC has responded to the spill <br />appropriately. The Division contacted Donna Stoner with the <br />Colorado Department of Public Health and the Environment in Grand <br />Junction and she informed me how her agency will proceed in this <br />matter. The Division encourages TCC to continue to follow the <br />appropriate regulations to clean-up the spill. <br />As the diesel fuel was contained with the earthen berm, the <br />Division's concern is with TCC's compliance with Rule 4.11.4, <br />Disposal of Noncoal Waste. Any soil contaminated by diesel fuel <br />should be removed and disposed of properly. A record of the <br />disposal should be maintained as required in the SPCC Plan. <br />Please continue to keep the Division informed as to the status of <br />the clean-up.
