<br />Introduction <br />r~ <br />This document is the decision package prepared by the Colorado Mined Land <br />Reclamation Division (the Division) for Permit Revision No. 2 to the Edna Mine <br />permit: (C-80-001). This document includes: 1) the Division's proposed <br />decision to approve, with one stipulation, the Permit Revision application, 2) <br />a summary of the review process for this revision, 3) a description of the <br />area under consideration in this revision, and 4) the written Findings of <br />Compliance the Division has made as required by the Colorado Mined Land <br />Reclamation Act. Detailed information on the findings can be found in the <br />Regulations of the Mined Land Reclamation Board for Coal Mining. The Edna <br />Mine 'is operated by the Pittsburg and Midway Coal Mining Company, and is <br />located approximately 4 miles north of the town of Oak Creek, Colorado, in <br />Routt County. Ownership of surface rights in the permit area are both private <br />and federal, as are the mineral rights. <br />PrOpOSed Decision <br />In accordance with Sec. 34-33-114(1), the Division proposes to approve, with <br />one Stipulation, a Permit Revision application for Pittsburg and Midway Coal <br />Mining Company's Edna Mine. The revision proposes a surface water and <br />sediment control system for the West Ridge portion of the mine. <br />This decision is based upon the finding that the operations being approved <br />will comply with all requirements of the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 1973, as amended, 34-33-101 et seq., and the <br />regulations promulgated pursuant to the Act. If no request for a formal <br />hearing is made within thirty days of the first publication of the issuance <br />of this proposed decision, then this decision becomes final. The permit <br />revision application and this document will become binding parts of the permit <br />upon approval. One Stipulation is imposed on the Division's approval: <br />STIPULATION k 31 <br />THE PERMITTEE SHALL COMPLETE THE CONSTRUCTION OF THE WEST RIDGE HYDROLOGIC <br />RECONSTRUCTION PLAN, AS DESCRIBED IN PERMIT REVISION # 2, NO LATER THAN <br />OCTOBER 31, 1995. BY OCTOBER 31 OF EACH YEAR UNTIL THEN, THE PERMITTEE SHALL <br />SUBMIT A REPORT TO THE DIVISION DESCRIBING THE PROGRESS ON THE PLAN DURING THE <br />CONSTRUCTION SEASON OF THAT YEAR. ONLY BY WRITTEN AGREEMENT OF THE DIVISION <br />MAY THE CONSTRUCTION DEADLINE BE ALTERED AND THEN ONLY IN THE EVENT OF <br />CLIMATIC OR OTHER CIRCUMSTANCES BEYOND THE CONTROL OF THE OPERATOR. <br />Prior to submittal of Permit Revision No. 2, three stipulations were attached <br />to the Edna Mine permit, in conjunction with Permit Revision No. 1. Those <br />three stipulations have all been complied with. Therefore, they are no longer <br />necessary. <br />Stipulation No. 1 required designs for the Moffat area sediment pond. These <br />designs were submitted and approved by the Division prior to construction of <br />the pond. <br />
