• • <br />Federal Coal Lease P-058300 <br />Special Stipulations <br />Sec. 15. (a) Cultural Resources. (1) Before undertaking any activities <br />that may disturb the surface of tbe leased lands, the lessee shall conduct s <br />cultural resource intensive field inventory on all lands included in the <br />lease. <br />The lessee shall conduct the inventory is the manner specified by the <br />authorized officer of the Bureau of Land Management (BIM). The inventory <br />shall be conducted by a qualified professional cultural resource specialist <br />(i.e., archaeologist, historian, or historical architect, as appropriate) <br />approved by the authorized officer of the BLM. A report of the inventory and <br />recommendations far protecting any identified cultural resources shall be <br />submitted to both the Regional Director of the Offlce of Surface Mining <br />Reclamation and Enforcement (OSMRE) and the authorized officer of the BLM. <br />The lessee shall undertake measures, in accordance with instructions from <br />the Regional Director, OSMRE, to protect cultural resources on the leased <br />lands at the mine plan stage. The lessee shall not commence surface <br />disturbing activities until permission to proceed is given bq OSMRE. <br />(2) The lessee shall protect all known cultural resource properties within <br />the lease area from lease-related activities until the cultural resource <br />mitigation measures can be implemented as part of an approved mining and <br />reclamation plan. <br />(3) The cost of conducting the inventory, preparing reports, and carrying <br />out mitigation measures shall be borne by the lessee. <br />(4) If cultural resources are discovered during operations under this <br />lease, the lessee shall immediately bring them to the attention of the <br />Regional Director, OSMRE. The lessee shall not disturb such resources except <br />as subsequently authorized by OSMRE. Within 2 working days of notification, <br />the Regional Director will examine or have examined any cultural resources <br />discovered and will determine if any action may be required to protect or <br />preserve such discoveries. The cost of data recovery for cultural resources <br />discovered during lease opera*_icns shall be borne by the lessor. <br />(5) All cultural resources shall remain under the ,jurisdiction of the <br />United States until ownership is determined under applicable law. <br />(b) Paleontological Resources. (1) Before undertaking any activities that <br />may disturb the surface of any leased lands, the lessee shall contact the <br />authorized officer of the BLM to determine whether the lessee will be required <br />to conduct a paleontological appraisal of the lease area that may be adversely <br />affected by lease-related activities. Any paleontological appraisal that is <br />required shall be conducted by a qualified paleontologist approved by the <br />authorized officer of the BLM. The paleontologic appraisal shall use the <br />published literature and, where appropriate, field appraisals to determine the <br />possible existence of larger and more conspicuous fossils of scientific <br />significance.
