Box 2905 <br />Durango, Colorado 81302 <br />MAR 71991 <br />Lease Terms and Conditions Readjusted <br />Coal lease P-058300 was issued effective September 11, 1941. The lease was readjusted <br />effective September 11, 1981, and became subject to the requirements of the Federal Coal <br />Leasing Amendments Act of 1976 (FCLAA), as amended (90 Stat. 1083). Coal lease P-058300 <br />is part of the King Mine Logical Mining Unit that was approved effective July 20, 1989. The <br />lease becomes subject to its third readjustment on September 11, 1991. <br />Notice of intent to readjust coal lease P-058300 was sent to the lessee, National King Coal, Inc., <br />by certified mail on September 11, 1989. As provided in the Mineral Leasing Act of 1920, as <br />amended (41 Stat. 437, 30 U.S.C. 181 ~J, the regulations at 43 CFR 3451 (1990), and <br />Sec. 24 of the lease, we aze hereby readjusting the terms and conditions of the lease. A copy of <br />the lease is enclosed. The readjusted terms and condtions shall become effective September 11, <br />1991. <br />The annual rental remains at $3 per acre or fraction thereof as provided in the current ]ease. The <br />production royalty rates, established by law and by regulations at 43 CFR 3473.3-2 will remain <br />at 12'/z pet>rent of the value of the coal removed from a surface mine and 8 percent for coal <br />removed from an underground mine. The value of the coal shall be determined in accordance <br />with the regulations at 30 CFR 206, as amended. 54 FR 1523, January 13, 1989, and 55 FR <br />35427, August 30, 1990. The terms and conditions for coal lease P-058300 remain basically <br />unchanged from the 1981 lease readjustment. The lease has been brought into conformity with <br />the current coal lease provisions, applicable regulations, and correct administrative agencies. <br />All payments of rentals and royalties must be submitted to the Minerals Management Service in <br />accordance with that agency's regularions in Title 30, Code of Federal R@g 1 i n .See the <br />enclosed notice. <br />
