Bond <br />A> The coal stockpiles at the New Elk Mine need to be bonded. The <br />Division policy is that sufficient bond must be posted to cover the <br />cost of either burying or transporting to an approved site one half <br />of the maximum tonnage capacity. The operator must submit the plan <br />for the Division's approval. <br />B) The bond is adequate for the rest of the operations at the New Elk <br />Mine. Please update the material, if necessary, in Exhibit 26, <br />Bond Calculation. <br />Section V - Bonding Summary <br />The following Corporate Surety is being held for the New Elk Mine. <br />Bond No. 5700589 - $2,545,000.00, dated June 1, 1991. <br />The 1988 Findings Document for Permit Renewal No. 1 required, through <br />Stipulation No. 43, that a bond of $2,450,000.00 be filed with the Division. <br />In June of 1991 the bond was increased to $2,545,000.00. <br />Since December, 1988, Minor Revision No. 18 through Minor Revision No. 43 have <br />added $13,542.70 to the bond liability. Similarly, Technical Revision No. 15 <br />through Technical Revision No. 25 have added $27,806.25 to the bond <br />liability. The total bond liability is $2,491,348.95, as of this midterm <br />date. This leaves an excess bond of $53,651.05. <br />JJD/yjb <br />5596E <br />
